Bengaluru Demolition: Lokayukta asks Bagmane Tech Park, BBMP to cooperate with each other

The tech park had approached the Lokayukta to stop the demolition drive on its premises. However, the Lokayukta refused to put a stay, but asked the civic officials to follow due process before the bulldozer action. The Lokayukta directed the BBMP engineer and joint commissioner to conduct an inquiry on the park's complaint. The matter was adjourned to October 11. "My order on Monday is based on the high court order as I asked the BBMP to comply with the court's verdict. I have asked them to follow due procedure by issuing notices to the property owners and hearing them. While this is not a stay order, I have clearly said the encroachment drive should continue wherever it is necessary," the Lokayukta told the media. Following the Lokayukta directive, the civic authorities halted the drive at the tech park. The BBMP said that they will follow the High Court's direction before demolishing any encroached portion. Located at CV Raman Nagar in Bengaluru, the park is home to some of the most prominent companies in the world. The BBMP has released a list of encroachers in the city, contributing to the massive floods that hit parts of the city last week. The Bagmane Group is one of the big names among them. Other big players like Wipro, Prestige, Rainbow Drive, and Eco Space have also been listed as encroachers on stormwater drains.

And so, BBMP has taken instant action and is on a massive drive to clear such encroachments. While, some buildings have been totally uprooted much to the dismay of the residents, some properties have been partially pruned easing the free flow of the Storm Water Drains (SWD’S). The survey carried out by the Bruhat Bengaluru Mahanagara Palike (BBMP) and the Revenue Department of the drain network found a whopping 1923 encroachments across about 400 KM in many prominent areas of the city. The BBMP has been proactive about this issue having already razed off 854 properties while many of the remaining properties are on the anvil. Properties of popular builders, government officers, martyrs’ and popular tech parks also feature in the list. There seems to be no hope of reprieve at all as the Supreme Court itself is in a relentless mood while the BBMP has approached the High Court to file caveats against people obtaining stay orders. Demolition drive continues in Bengaluru, encroachments built on storm water drains razed

The Bruhat Bengaluru Mahanagara Palike (BBMP) continued demolitions on encroachments in Bengaluru’s Mahadevapura and surrounding areas on Monday, September 12. The city’s civic authorities brought in excavators and bulldozers to demolish encroachments built on rajakaluves (storm water drains) of Chinnappanahalli lake in Mahadevapura. These actions were part of the measures taken by the government to remove encroachments that led to the recent flooding in parts of the city after days of heavy rain. Illegal encroachments on stormwater drains over the years were identified as one of the major causes for the flooding in the city last week. They were subsequently identified by the BBMP for demolition. Following Chief Minister Basavaraj Bommai’s A ground that was constructed over a stormwater drain on the Gopalan College campus in Basavanagara was also razed. In addition, homes and shops in Munnekolala were demolished, and around 25-30 more buildings have been marked for the same. Residents in the area were issued notices by the authorities to vacate their homes. Addressing the media, BBMP Chief Engineer Basavaraj stated that a stretch of about 20 buildings extending from Munnekolala to Spice Garden has been marked for demolition. Shivakumar, who went around the city inspecting storm-water drain works in flood-prone areas on Thursday, said the State will use every possible law to raze encroachment of rajakaluves by real estate companies. Mr. Shivakumar visited areas in Yemalur, Sarjapur, Varathur, and other places and directed the Bruhat Bengaluru Mahanagara Palike (BBMP) to complete the works as soon as possible. After Mr. Shivakumar took charge, this was the first time he inspected SWD works. It should be noted the BBMP during its flood assessment had cited SWD encroachment as a major reason for waterlogging. Stay against demolition Mr. Shivakumar, while inspecting the works, said he found construction of high-rise buildings and layouts by builders and developers encroaching the drains. In about 118 locations, stay was brought against the BBMP from carrying out demolition drive. I. Overview In the month of August 2022, the city of Bengaluru during its monsoon season, particularly experienced heavy rainfall leading to congested roads and floods resulting in the displacement of infrastructural facilities located within and at the extended areas of the city. The reason however, for such a situation was not entirely connected to heavy rainfall, it was also attributed to the building structures which were laid down on the storm water drains, the mismanagement of resources and haphazard administration of the governing bodies responsible for the maintenance of such storm water drains, thereby obstructing the flow of rainwater which rendered the city in a handicapped state of affairs. The Bruhat Bangalore Mahanagara Palike (" BBMP"), carried out anti-encroachment drives in its attempt to arrive at a solution for the intense flood conditions and one such incident was on 17 August 2022, wherein the BBMP released a notification 1, issued by the Joint Commissioner listing 15 (fifteen) different real estate developers as well IT Parks in specific to the Mahavedpura constituency as entities who had encroached the areas of the storm water drains (" SWD") also termed as 'Rajakaluve'.
