Maharashtra Political Crisis: In a major setback to Uddhav Thackeray and his team, the Supreme Court on Thursday said that current Maharashtra CM Eknath Shinde will get to keep his job, even though Maharashtra Governor did not act in accordance with law. The apex court held that the Maharashtra Speaker's decision to appoint Bharatshet Gogawale, who was backed by the Shinde faction, as the Whip of the Shiv Sena party was illegal, Live Law reported on Thursday. The five-judge Constitution Bench, comprising CJI Chandrachud and Justices M R Shah, Krishna Murari, Hima Kohli, and P S Narasimha, on Thursday said: 1. The governor had no objective material in calling for a floor test. "If the Speaker and the government circumvent the no-confidence motion, the Governor will be justified in calling for a floor test without the aid and advise of the council of ministers...The assembly was not in session when the Leader of Opposition Devendra Fadnavis wrote to the Government. The opposition parties did not issue any no-confidence motion. The Governor had no objective material to doubt the confidence of the Govt," he said. 2. In what has signalled a rift between the Shiv Sena and BJP, the Eknath Shinde-led party has come out with full-page newspaper advertisements claiming that people wish to see him as the next Chief Minister of Maharashtra over BJP’s Devendra Fadnavis. The ad reads how Prime Minister Narendra Modi and Shinde have secured the highest position for Maharashtra through recent welfare projects. The ad is headlined - “Modi for India, Shinde for Maharashtra” and goes on to add that it is “The Dream Team Loved by All”. The ad has a photo of Prime Minister Narendra Modi and Shinde smiling at each other while the latter is showing something on his mobile phone. The ad does not have a photo of Fadnavis, who is the BJP’s troubleshooter in Maharashtra and the current Deputy Chief Minister. Amid growing tensions within Maharashtra’s ruling parties, the Shiv Sena led by Chief Minister Eknath Shinde and the Bharatiya Janata Party (BJP), Deputy CM and State BJP leader Devendra Fadnavis on June 13 cancelled his visit to Kolhapur district citing ‘medical reasons’. Friction arose between the ‘Mahayuti’ (translated ‘grand alliance’) partners after a newspaper advertisement placed by the Shinde-led Sena cited a survey which claimed Mr. Shinde was more preferred as the State’s CM than Mr. Fadnavis. Leaders from the Shinde camp scrambled to downplay any differences between their party and the BJP over the survey while the Opposition Maha Vikas Aghadi (MVA) pooh-poohed the government’s survey, saying it was “laughable” that the Shinde camp had deployed an agency to conduct a survey obviously favourable to them. “There are no differences between the BJP and the Shiv Sena.
