Justice B V Nagarathna: The woman who could become the first female CJI of India

It's a wonder India has lagged in involvement of women in the Judicial services. We did not have a woman Chief Justice till now and it has already been 75 years to the country's independence. India is likely to get its first woman CJI as soon as it turns 80 in 2027. How is it? Basically, the Collegium that is headed by the current CJI, NV Ramana has recommended three women among the 9 members as Judges of the Supreme Court. So one of those three women can head the apex court when it is time. It is expected that Justice BV Nagarathna could be the one to become the first female Chief Justice of India in February 2027. The three women judges that have been recommended are - Justice BV Nagarathna of the Karnataka High Court, Justice Hima Kohli, Chief Justice of the Telangana High Court and Justice Bela Trivedi of the Gujarat High Court. These three women judges have been elevated to the Supreme Court after a 22 month impasse of the Supreme Court Collegium recommendation. About Justice BV Nagarathna: She is presently the Judge of the Karnataka High Court and has also been recommended by the Collegium. Even after 70 years of its existence, the top court has not had a woman Chief Justice of India. The Supreme Court of India is also mainly a male-dominated institution. It has a strength of 34 judges, including the Chief Justice of India, but it has only one woman judge after the recent retirement of Justice Indu Malhotra. There have been very few women judges in the Supreme Court up till now. Justice Fathima Beevi was the first woman judge of the Supreme Court of India, appointed in 1989. The second woman judge was Justice Sujata V Manohar, who was elevated to the Supreme Court in 1994. The third woman judge, Justice Ruma Pal, came to the Supreme Court in the year 2000. After her retirement, it was Justice Gyan Sudha Mishra who came to the Supreme Court in 2010. In 2011, Justice Ranjana Prakash Desai was appointed to the Supreme Court. Justice R Banumathi was elevated to the Supreme Court in 2014. Justices Indu Malhotra and Indira Banerjee, who will retire next year, came to the Supreme Court in 2018. Leila Seth, First Woman Chief Justice of High Court, No More

New Delhi: Justice (retd) Leila Seth, the first woman chief justice of a high court in India, breathed her last on Friday night at her Noida residence. Mother of celebrated author Vikram Seth, Leila was 86. "She died of cardiac seizure last night, at about 10:28 PM. My brother Vikram, sister and our other family members are here," PTI quoted Leila's son Shantum Seth as saying. Seth was also one of the three members of the Justice Verma Committee which was constituted in 2012 to recommend amendments to the Criminal Law so as to provide for quicker trial and enhanced punishment for criminals accused of committing sexual assault against women, post the gruesome December 16 gangrape in Delhi. The eminent jurist, the mother of "A Suitable Boy" writer, was herself an author and her autobiography 'On Balance' was a bestseller. Seth had also authored 'Talking of Justice: People's Rights in Modern India', published in 2014, which talked of several critical issues that she had engaged with in a legal career spanning over 50 years.(With inputs from PTI)

Much needed and long overdue: a woman Chief Justice

With the retirement of Justice R Banumathi and the recent retirement of another women judge, Justice Indu Malhotra, one can hear voices from the corridors of the Supreme Court (SC) advocating for the appointment of more women judges to the apex court. This debate is not new, but it has resurfaced again after a judge of the Madhya Pradesh High Court imposed a condition while granting bail to a man accused of sexual assault — that he should go to the residence of the victim and get a Rakhi tied to his wrist. Nine women lawyers approached the SC to challenge the order and while hearing this petition, the SC had issued a notice to the Attorney General to seek his views and suggestions on the issue. Among the written submissions filed by the AG, one was that improving the representation of women in the judiciary could go a long way towards attaining a more balanced and empathetic approach in cases involving sexual violence. The AG also brought up the fact that there has never been a woman Chief Justice of India (CJI). This set the ball rolling on a discussion about Indian having its first woman Chief Justice, a milestone that should have been achieved long ago. The then CJI S A Bobde, while hearing a petition of a women lawyers’ body seeking consideration for the appointment of meritorious women lawyers practising in SC and high courts, remarked that the time has come for the first woman CJI.
