49th GST Council Announcements: GST Compensation Cess Cleared, GoM Report On GST Appellate Tribunal, Pan Masala Accepted

Finance Minister Nirmala Sitharaman, after the 49th GST council meeting, announced some major decisions take by the apex taxation body. The Finance Minister said that the entire dues on the pending balance of the GST compensation cess of Rs 16,982 crores for June will be cleared. The 49th meeting of the GST Council chaired by Union Finance Minister Nirmala Sitharaman was also attended by Minister of State Pankaj Chaudhary, Finance Ministers of States and UTs, and senior officers of the government. The GST council also decided to reduce the Goods and Service Tax on liquid jaggery, pencil sharpeners, and certain tracking devices. Highlights From the 49th GST Council Announcement - Finance Minister Nirmala Sitharaman said that the entire balance of GST compensation which is to a total of Rs 16,982 crores for June will be cleared. - She added that although this amount is not available in the compensation fund as of today, we've decided to release this amount from the Centre’s resources. A pencil sold with sharpener will attract higher GST than a pencil sold alone since the sale of a pencil and sharpener together is ‘mixed supply’, the Gujarat AAR (GAAR) has held. Businesses either supply goods or services alone, or bundle goods and/ or services. Bundled supplies are categorised into two – mixed and composite supply. While mixed supply refers to supply of two or more goods and/ or supplies together at a single price and each of them can be supplied separately, composite supply refers to supply of two or more goods or services or both, which are naturally bundled and supplied in conjunction with each other in the ordinary course of business, one of which is a principal supply. The tax liability in case of mixed supply is fixed on the basis of goods or services that have the highest rate. In case of composite supply, one good or service is taken as a principal supply, the tax rate for which will apply to the entire supply.
