The Iterations, before and after Comparing the two iterations of the RTH Bill, one before and another after the select committee review, is a good starting point for a review. The primary iteration was sent for the select committee’s review in 2022, and the amended Bill was passed on March 21, 2023, which stoked protests. Even a cursory review brings out how the amended version, which sparked the row, was itself a highly moderated version attuned strongly to the interests of the medical community. Following the select committee amendments, some definitions (accidental emergency, emergency care, and first aid), were added to the Bill. In addition, the term ‘designated health care centres’ was introduced, and a reimbursement clause for unpaid emergency care was added. These additions are commendable. However, most other changes in the amended Bill were not so salutary at least as far as protecting public health interests is concerned. • The Bill provides the right to health and access to healthcare for people in the state.This includes free health care services at any clinical establishment to residents of the state. • The Bill sets certain obligations on the state government to ensure the right to health and maintain public health. • Health Authorities will be set up at the state and district level. These bodies will formulate, implement, monitor, and develop mechanisms for quality healthcare and management of public health emergencies. Key Issues and Analysis • There is no provision for reimbursing private health establishments for providing free healthcare services. Thismay make these establishments commercially unviable and violate Article 19(1)(g) of the Constitution. • The District Health Authority is required to upload an action taken report on the web portal for complaints. The Bill does not specify who will have access to the report on the web portal. This may infringe on the patient’s right to privacy in medical cases. • Implementing the right to health may increase the financial obligation of the state. On Tuesday, Rajasthan became the first state in India to introduce a Right to Health Act. In many ways, this is a landmark legislation as it makes access to healthcare a legal entitlement of every resident of the state. Under the law, neither government nor private hospitals nor doctors can refuse a person seeking emergency treatment. “It is a step in the right direction,” said health activist Dr Abhay Shukla, who advised the Rajasthan government in 2019 in drafting the bill. “We don’t know why the private sector is creating a hue and cry.” Shukla was referring to protests by several doctor groups in the state, who fear that the law will make them vulnerable. For the Ashok Gehlot government, which runs several flagship health schemes, the passage of the bill is an important step ahead of the approaching assembly elections. But while the private sector has put up stiff opposition to the law, health activists, too, believe it falls short of its initial promise. The Rajasthan Assembly on March 21, passed the Right to Health (RTH) Bill and since then it has been in the news. Doctors on Monday, March 27 held a massive protest against the Bill in Jaipur at Panch Batti. Sources claimed that the Indian Medical Association called March 27 a ‘black day’ against the Right to Health Bill. The rally was conducted to press the demand for the Act's withdrawal. Private doctors have threatened that their hospitals will not be part of any healthcare scheme by the state in the future. All You Need To Know On Right To Health Bill And Doctors Protest In Rajasthan

New Delhi: Private hospital doctors in Rajasthan took to the streets in a massive protest against the state government's 'Right to Health Bill', which gives people the right to free emergency treatment at all government hospitals and privately-run establishments. The Bill, which was tabled in the state assembly by health minister Prasadi Lal Meena, was passed by voice vote on Tuesday. The Rajasthan police baton-charged and used water cannons on the protestors to disperse them as they were marching towards the Rajasthan Assembly on Tuesday, where the Budget session was underway, to force the government to take back the Right to Health Bill. Around 2,500 private hospital operators across the state participated in the protest. Also, according to the bill, all residents will be entitled to emergency treatment and care "without prepayment of requisite fee or charges" by any public health institution, health care establishments and designated health care centres. The Bill further states that no healthcare provider shall delay treatment merely on the grounds of receiving police clearance or a police report. After emergency care, stabilisation, and referral of the patient, if they do not pay the requisite charges, the government will reimburse the health care provider, the Bill said.
