A bench headed by Chief Justice of India D.Y. Chandrachud said it cannot allow the Supreme Court to become a "super Article 226 court" (a super high court) and entertain everything raised using Article 32. Article 226 provides for high courts to issue instructions or writs to government authorities. Advocate Vrinda Grover mentioned the Muslim body's plea before the court and submitted that the Kerala High Court was not hearing the matter before the film's release on May 5. Grover argued that they are vilifying the community and marketing it as the truth and also, they do not have a disclaimer also that this is a work of fiction. Kochi: The right of autonomy over one's body is often denied to the fairer sex and they are bullied, discriminated against, isolated and persecuted for making choices about their bodies and lives, the Kerala High Court said on Monday while discharging a women's rights activist in a POCSO case. Rehana Fathima, a woman's right activist, was facing charges under various provisions of the POCSO, Juvenile Justice and the Information Technology (IT) Acts for circulating a video in which she was seen posing semi-nude for her minor children, allowing them to paint on her body. Discharging her from the case, Justice Kauser Edappagath said that from the allegations against the 33-year-old activist, it was not possible to anyone to infer that her children were used for any real or simulated sexual acts and that too for sexual gratification. The court said that she only allowed her body to be used as a canvas for her children to paint on. "The right of a woman to make autonomous decisions about her body is at the very core of her fundamental right to equality and privacy. It also falls within the realm of personal liberty guaranteed by Article 21 of the Constitution," it said. The order came on Fathima's appeal against a trial court decision dismissing her plea to be discharged from the case. In her appeal in the Kerala high court, Rehana Fathima had asserted that the body painting was meant as a political statement against the default view of society that the naked upper body of the female is sexualised in all contexts, whereas the naked male upper body is not treated to this default sexualisation. 2. New Delhi: The Supreme Court today agreed to hear on May 12 a plea by the producers of controversial multilingual film 'The Kerala Story' against the West Bengal government's ban on screening of the movie after the makers said they are "losing money everyday". Senior advocate Harish Salve mentioned the matter for urgent listing before a bench comprising Chief Justice DY Chandrachud and Justice PS Narasimha. Mr Salve said the petition challenges the ban by the West Bengal government and the "de-facto" ban in Tamil Nadu. The bench said it had on Tuesday posted for May 15 a separate plea against the Kerala High Court order refusing to stay the release of the movie and the fresh plea would also be heard on that day. However, the bench agreed to list the plea for hearing on May 12 after Salve said, "We are losing money everyday." 'The Kerala Story' starring Adah Sharma was released in cinemas on May 5. Directed by Sudipto Sen, the film depicts how women from Kerala were forced to convert to Islam and recruited by the terror group Islamic State(IS). On May 8, West Bengal Chief Minister Mamata Banerjee had ordered an immediate ban on the screening of the film in the state to avoid "any incident of hatred and violence", a senior state government official had said. By Kanu Sarda: For the second day in a row, the Supreme Court on Thursday refused to interfere with the release of the film ‘The Kerala Story’ or pass any orders for urgent listing of the case before the Kerala High Court. The Apex court observed that a film is made with a lot of hard work of producer and actors. A bench of Chief Justice of India DY Chandrachud, and Justices PS Narasimha and JB Pardiwala asked Senior Advocate Huzefa Ahmadi, appearing for petitioner Qurban Ali, a journalist, to approach the Kerala High Court where the matter was pending. READ | Pressing for an urgent hearing in the case, Ahmadi told the bench that they haven't got the hearing in the Kerala High Court today, and by tomorrow the film would be released. He said it was not a normal movie, and requested the bench to at least see the transcript of the trailer, which was “very disturbing." ALSO READ | Ahmadi further stressed that a lot of agony will be prevented if he gets a hearing by midnight today as the film will be released on OTT platforms. Responding to this, the CJI said, "It is 2:30 pm now. You can go now. If a bench assigned by the Chief Justice is not available, then you can surely go now and have another bench or alternate assignment." New Delhi: The Supreme Court today sought to know the rationale behind 'The Kerala Story' movie being banned in West Bengal when it is running across the country without any problem. "Why should West Bengal ban the movie? It is running in the rest of the country including in states having similar demographic composition and nothing has happened. This has nothing to do with the artistic value of the film," observed a bench of Chief Justice of India DY Chandrachud and Justice PS Narasimha, and issued notices to West Bengal and Tamil Nadu. Though the movie has not been banned in Tamil Nadu, theatre owners have decided not to screen it over law and order concerns, a move that the makers claimed was a "de facto ban". Senior advocate Abhishek Singhvi, appearing for the West Bengal government, cited intelligence inputs to claim there may be a law and order problem. The court also sought to know about the security provided to theatres screening the movie in Tamil Nadu. It told the state's counsel that the government cannot look the other way when theatres are attacked. The matter has been posted to next Wednesday.
