While considering several petitions filed by both factions, a bench comprising Chief Justice of India NV Ramana, Justice Krishna Murari and Justice Hima Kohli observed that the case involves important constitutional questions and During the hearing, Senior Advocate Kapil Sibal arguing on behalf of the Thackeray faction submitted that the Tenth Schedule, which is meant to prevent defections, is being used to instigate defections, and has been made ‘topsy-turvy’. While saying that an illegitimate government shouldn’t stay for a single day, Kapil Sibal asked the court to decide the issues involved soon, as every day's delay will play havoc with democratic decisions.
