Six new CJIs in six years likely, goes against law panel’s suggestion

Express News Service NEW DELHI: India will see six Chief Justices in a span of six years beginning this year. The current Chief Justice of India N V Ramana will head the institution for a year or so only. With a sanctioned strength of 34 judges, six positions of judges are lying vacant in the Supreme Court and four judges will retire by the end of this year. Three more judges will retire by August 2022, and with this, CJI Ramana will have an opportunity to recommend the names of around 13 Supreme Court judges during his tenure ending next year in August. The line of succession till 2027 will also see the youngest Justice D Y Chandrachud as the Chief Justice of India, who will head the institution for over two years. With the exception of unforeseen circumstances, such as death, early retirement or impeachment, the order of upcoming Chief Justices of India is all set. With the Law Commission of India’s recommendation that the Chief Justice of India should have a minimum tenure of two years in the apex court, an analysis of the future CJIs based on their seniority reveals that no judge would be able to stay there beyond a year and a half. DY Chandrachud: Justice DY Chandrachud appointed 50th Chief Justice of India

NEW DELHI: Justice DY Chandrachud has been appointed as the 50th Chief Justice of India. Justice Chandrachud would be sworn in by President Droupadi Murmu as CJI on November 9. He will succeed Justice UU Lalit, who is serving a short tenure of just 74 days. "Extending my best wishes to Justice DY Chandrachud for the formal oath taking ceremony on 9th Nov," law minister Kiren Rijiju said after the announcement. Last week, CJI Lalit had recommended Justice Chandrachud's name as his successor since he is the senior-most Supreme Court judge. Justice Chandrachud been part of several Constitution benches and landmark verdicts of the top court including on matters relating to the Ayodhya land dispute, right to privacy and adultery. Incidently, he will take charge on the day the apex court had passed the historic judgment in the Ayodhya case. Justice Chandrachud, who was elevated to the top court on May 13, 2016, will have a tenure of two years as the CJI and is due to retire on November 10, 2024. 50th Chief Justice of India:President of India Droupadi Murmu on November 9, 2022, administered the oath of office to Dhananjaya Y Chandrachud as he took over as the 50th Chief Justice of India, replacing UU Lalit. Through the course of the past year, CJI Ramana has emerged as a people’s judge with a sharp focus on promoting access to justice. In the pursuit of this, his priorities have been filling judicial vacancies and improving judicial infrastructure across Courts in India. The Supreme Court has witnessed some refreshing changes in its judicial approach during the tenure of CJI Ramana. Apart from his orders that made headlines in cases like Pegasus, vacancies in tribunals and the Even during court hearings, Justice Ramana has always maintained a calm and composed demeanour. Justice UU Lalit appointed 49th Chief Justice of India

While Supreme Court judges retire on attaining the age of 65 years, judges of the 25 high courts retire at 62. Justice Lalit will be the second CJI who was directly elevated to the apex court bench from the Bar. Justice S M Sikri, who became the 13th CJI in January 1971, was the first lawyer to be elevated directly to the top court bench in March 1964. "In exercise of the powers conferred by clause (2) of Article 124 of the Constitution of India, the President is pleased to appoint Shri Justice Uday Umesh Lalit, judge of the Supreme Court, to be the Chief Justice of India with effect from 27 August 2022," a law ministry notification said. Justice Lalit has been part of several landmark judgements including the one which held the practice of divorce through instant triple talaq among Muslims illegal and unconstitutional. A renowned senior advocate, he was appointed a judge of the Supreme Court on August 13, 2014. Justice U U Lalit took oath as the 49th Chief Justice of India (CJI) on Saturday. President Droupadi Murmu administered the oath of office to Justice Lalit at the swearing-in ceremony held in the Durbar Hall of Rashtrapati Bhavan. The new CJI has a short tenure and will hold office till November 8, 2022. He succeeds Chief Justice N V Ramana who retired Friday. Speaking at a farewell event organised by the Supreme Court Bar Association for Chief Justice Ramana, Justice Lalit laid out his priorities, saying he “will strive hard to make the process of listing cases as simple as transparent as possible”, make mentioning – where lawyers bring urgent matters to the notice of the court – easier, and strive to ensure that there is at least one Constitution bench functioning throughout the year.
