Zubair Arrest: Delhi Court's Bail Order for Zubair Shows How Law is Supposed to Protect Liberty

The only saving grace to be found in his current situation, is that his continued incarceration can no longer be attributed to the Delhi courts, after a sessions judge of the Patiala House court It was the Delhi Police who had managed to first arrest the fact-checker, using this FIR which had just been filed four years after the tweet had been published. He had obtained protection from coercive action in another case registered in Delhi against him, and there were a few cases against him in Uttar Pradesh as well, but it was no surprise that he had not been arrested in any of them, as the cases were so obviously baseless that even the police would never have thought a court would allow him to be remanded to custody. At least, that's what you would imagine the courts would do with a baseless case. Unfortunately, the magistrate's court in Delhi not only remanded Zubair to police custody, it then denied him bail and sent him to 14-days' judicial custody. At this point, with courts in Uttar Pradesh also sending him to custody in the cases against him there, it looked like his goose was cooked. The Supreme Court granted him interim bail in one of those UP cases, but the order denying him bail in Delhi and the other UP cases meant that he could not be set free. This remains the case despite the order of the Delhi sessions court granting him bail, thanks to the UP cases. But in the order of the sessions court, we see how the law is supposed to be used to protect individual liberty...

'Supreme Court's Verdict on Zubair Is a Message To Lower Courts': Vrinda Grover

After 23 days of imprisonment, Alt News co-founder and fact-checker Mohammed Zubair The Quint, Zubair's lawyer Vrinda Grover, who represented him in the case, said that the court's verdict was a message to the lower courts as well as the police. "The verdict is telling the subordinate judiciary that they are the first line of defense of civil liberties. So, when someone is placed in front of you, simply because the police asks for remand...you must scrutinise, if a prima facie case is made out; and if is not, give bail," Grover said. She added that this wasn't followed in Zubair's case. Grover said that the SC had made similar observations about bail being the norm and jail being the exception in previous cases as well. "Clearly, it is time for the SC to not only say this in judgments but also set down clear guidelines. Otherwise, judgments that have repeatedly said that bail should be the norm and jail should be the exception can't be enforced. Very clear guidelines have to be laid down for the district judiciary to grant bail where it is deserved and to ensure that personal liberty must remain sacred," she said. "Zubair suffered incarceration for 23 days. Why should he have suffered? That is the question that we must ask. Why even one day of custody?" Grover asked. Grover also contested allegations of Zubair's tweets being inciteful or provocative. "Zubair has not crossed the line where you fall foul of the law and incite hatred or ill-will," she said. "However, there is...

India’s Supreme Court has ordered the release on bail of a prominent journalist While granting Zubair, 39, bail on Wednesday, the judges stated that “power of arrests must be pursued sparingly”. The court also stated that while investigations can continue, there was no justification for keeping Zubair in custody. Zubair’s lawyer had earlier said the case bordered on the absurd, because Zubair, a Muslim, had used satire from a Hindi movie in his 2018 tweet and there was no evidence that he had hurt the religious sentiments of Hindus. Zubair and his colleagues accused the federal government of using the police to silence the voice of journalists and other critics. “It’s a huge slap on the face of the Uttar Pradesh police which became an instrument for the political persecution of Mohammed Zubair with one bogus FIR [first information report] after the other, designed only to keep him in jail for as long as it was going to be possible,” Siddharth Varadarajan, founding editor of The Wire news website, told Al Jazeera. “The Supreme Court has done the right thing but it should also force the BJP in Uttar Pradesh, particularly chief minister [Yogi] Adityanath to introspect about the kind of reputation that law enforcement now has in the state.” Earlier this year, Zubair, who has more than half a million Twitter followers, had drawn attention to an Bail in one case, custody in another, escorted to Sitapur, Lakhimpur, Hathras, Delhi, Bangalore, formation of SIT, vilification by medi...
